Bayer Pharmaceuticals introduced "Baycol" to the American market in 1999. At the urging of the Food and Drug Administration, Bayer removed Baycol from the market on August 8, 2001, following reports of fifty-two deaths to the FDA. Of those, 12 deaths occurred when patients used Baycol in combination with gemfibrozil (lopid), another cholesterol-lowering drug.
Baycol is in a class of drugs called, "statins." Physicians prescribed Baycol and other statins to treat high cholesterol. There are five other statins presently on the market. These are safer alternatives. Only Baycol has been removed because of the potential hazards to its users. The major side effect of Baycol ingestion is rhabdomyolysis, a disease characterized by a breakdown and release of the contents of muscle cells into the bloodstream. As a result, injury to the kidney occurs because of the toxic effects of the contents of muscle cells. This condition may be fatal, or may be non-fatal but cause kidney failure, liver injury, seizures, joint and muscle pain, and fatigue for the rest of the patient's life.
In addition, patients who develop rhabdomyolysis often have muscle aches involving their calves, back, or their entire body. Weakness, fever, nausea, vomiting, and passing of dark urine may accompany the pain. The first signs of injury are muscle pain and weakness. Baycol attorneys have been busy since the 2001 Baycol recall. Withdrawn in August 2001, Baycol attorneys were immediately drawn to the news breaking drug recall. Many people had been reporting a potentially deadly Baycol side effect called rhabdomyolysis and sought the advice of Baycol attorneys. Rhabdomyolysis has been linked to all statin drug types, but it was found that the use of Baycol had caused a dramatic increase in side effect incidence that Baycol attorneys were asked to represent.
At the time of the Baycol recall there had been reports of 52 deaths, with 416 cases of rhabdomyolysis reported, 31 of the deaths being attributed to the rare condition. Baycol attorneys were immediately asked for representation as more and more reports showed how deadly and dangerous Baycol’s presence on the market was. It was later discovered that Baycol caused over 100 deaths, in addition to countless side effects that Baycol attorneys were trying to recover damages for.
As of August 2003, Bayer said it had paid $477 million to settle out of court 1,342 Baycol lawsuits, with Baycol attorneys still fighting for the over 11,000 Baycol lawsuits that Bayer still must face. It is important to contact a Baycol attorney that has the necessary experience and resources to successfully represent a Baycol lawsuit against a pharmaceutical company.
